Converting to Islam doesn’t automatically confer Backward Class status: Supreme Court
What Happened
The Supreme Court dismissed the Tamil Nadu government’s appeal against a Madras High Court ruling that struck down a 2024 government order. That order allowed people from BC, MBC, DNC and SC backgrounds who converted to Islam to be treated as Backward Class Muslims for reservation purposes.
Key Takeaways
The court held that conversion alone does not automatically make a person a member of a notified Backward Class Muslim community, and a person’s pre-conversion social backwardness cannot by itself establish eligibility for reservation under Article 16(4). Tamil Nadu has a 3.5% reservation for Backward Class Muslims within its state reservation framework.
