Senior Advocate Gourab Banerji said India’s rapid expansion in renewable energy is likely to create more disputes that fall outside the jurisdiction of electricity regulators and are instead resolved through arbitration. While tariff-related matters will remain with regulators, disputes involving EPC contracts, equipment supply, operations and maintenance, energy storage, performance issues and shareholder agreements are increasingly suited to arbitration.
